1. Introduction

These Terms of Service ("Terms") govern your use of Pluggie services ("Service") provided by PAZOOCHA LTD ("we", "us", "our"). By using our Service, you agree to these Terms.

2. Service Description

Pluggie is a secure remote access service that enables you to safely access your devices (especially Home Assistant installations) from anywhere in the world. The service includes advanced features such as geographic and IP-based traffic filtering, automatic SSL certificate management, and your own domain support.

3. Software License

Pluggie apps are provided under the MIT License. The software is provided "as is", without warranty of any kind, express or implied. You may modify and distribute the software according to the MIT License terms.

4. Free and Paid Services

4.1. Free programme is provided without any time limitation. The programme itself is lifetime, however, we reserve the right to modify or discontinue the programme at any time in accordance with these Terms.

4.2. Free programme includes unlimited monthly traffic. The first 1GB every 30 days are provided at full speed, after which connection speed will be reduced to 128Kbps until the end of the current 30-day period, when full speed will be restored.

4.3. Paid programme ("Want some more?") plan includes 5GB of traffic at full speed every 30 days, after which connection speed will be reduced to 128Kbps until the end of the current 30-day period. Current features and limitations for each plan are specified on our pricing page.

5. Acceptable Use

You agree not to use the Service for:

While streaming multimedia files and data is not prohibited, we advise against this usage as it may quickly consume your allocated traffic quota.

6. Service Limitations and Warranty Disclaimer

6.1. We do not warrant uninterrupted service availability.

6.2. We are not liable for damages caused by: service interruptions or downtime, DDoS or other cyber attacks, unauthorized use resulting from compromised credentials, network connectivity issues, third-party service disruptions, data loss or corruption, or force majeure events.

6.3. Service performance may be affected by: your internet connection quality, geographic location, network congestion, device hardware limitations, or concurrent connection limits.

9. Payments, Cancellation and Refunds

9.1. Subscription billing. Paid subscriptions are billed monthly in advance via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

9.2. Cancellation. You may cancel your subscription at any time through your account settings or by contacting support@pluggie.net. Cancellation takes effect at the end of the current billing period. Your tunnel remains active until that date, after which it is automatically deactivated. No partial refunds are issued for unused days within a paid period.

9.3. No refunds. All payments are non-refundable. We do not issue refunds or credits for partial billing periods, unused traffic, or unused subscription time, except where required by applicable law or at our sole discretion in exceptional circumstances.

9.4. Immediate termination without refund. We reserve the right to immediately terminate the Service without refund if you use the Service for illegal purposes, your usage threatens or compromises our infrastructure, or you violate these Terms in any significant way.

9.5. Payment failures. If a scheduled payment fails, your connection speed will be reduced to 128 Kbps. If payment is not recovered within the grace period defined by our payment processor's retry schedule, your subscription will be cancelled and your tunnel deactivated. We will notify you by email before deactivation.

10. Limitation of Liability

Our total liability for any claims arising from or related to the Service is limited to the amount actually paid by you for the Service. We are not liable for indirect or consequential damages.

11. Changes to Terms

We may modify these Terms at any time. Users who have provided an email address in their profile will be notified of any changes via email. Continued use of the Service after such notification constitutes acceptance of modified Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of London, United Kingdom.
